These terms of service apply to the ordering of digital product tickets (hereinafter also referred to as “product”) and pre-orders (hereinafter also referred to as “pre-orders”), as well as the use of a business account (hereinafter also referred to as “business account”) on our online store shop.noho.fi. These terms of service are valid starting from July 31, 2023. We reserve the right to unilaterally change the terms of service from time to time, so please familiarize yourself with the terms of service each time you order digital product tickets or other aforementioned products or services from our online store.

Products and Product Prices

The characteristics and prices of the products in the online store are presented in connection with the product descriptions of each item. We reserve the right to make changes to prices and delivery costs, so please check these prices in your shopping cart before accepting the order. The prices of products include taxes, which are shown in the shopping cart and order confirmation.

Delivery Costs

Possible delivery costs for an order depend on the product itself, the delivery location, and the chosen delivery method. These costs will be automatically added to the total amount of the order if there are delivery-related expenses included in the order. You will see the applicable delivery costs for your order in your shopping cart before accepting the order.

Ordering and Agreement

You can order products from our online store by adding them to the shopping cart, confirming the order, and paying for the order using the available payment methods. By placing an order through our online store, you are required to have familiarized yourself with and agreed to the currently valid terms of service. You understand that the order you accept and confirm is binding and creates an agreement between us based on these terms of service.

Payment and Payment Methods

You can pay for your order through the available payment methods on the online store. The available payment options are either invoicing or online payment (Paytrail), depending on the service or business account. The invoicing payment option is only available for approved business account users.

Invoicing (Business Account)

By logging in to the business account and placing an order, the account holder gains access to valid invoicing rights. Invoicing is based on the realization, and the billing period is 14 days from the formation of the invoice. Invoicing for companies 15 €.

Online Payment (Payment Service Provider)

The payment mediation service is provided by Paytrail Oyj (2122839-7) in cooperation with Finnish banks and credit institutions. Paytrail Oyj appears as the recipient of the payment on the account statement or credit card bill and transfers the payment to the merchant. Paytrail Oyj holds a payment institution license. In case of complaints, please contact the product provider first.

Order and Payment Confirmation

After a successful order, you will receive an order confirmation by email, so please provide your email address when placing an order. The order confirmation will also confirm the payment method used.

If, due to unforeseen circumstances, we are unable to confirm your order, we will inform you of this via email as soon as possible.

Delivery Method and Time

We will deliver your order according to the specific delivery methods and the information you have provided. Some of the items in your order may be seasonal, and therefore, we reserve the right to make changes to deliveries.

The delivery time is based on the selected delivery option for the ordered service, where the delivery and availability time are specified. Generally, deliveries are either digital and available only at specific times or event-related, in which case the deliveries are based on the event timings.

Cancellation Right and Return Conditions for Consumer Customers

These terms of service apply to digital product tickets, food, and beverages (products that can quickly spoil or expire), as well as restaurant services. Product tickets are usable at a specific restaurant during a designated time or within a certain period. After placing an order, the consumer will receive an order confirmation with a link to activate or share the product ticket, which constitutes fulfilling the contract during the withdrawal period. For these reasons, there is no right to cancel or return.

If you are a consumer, by accepting these terms of service, you explicitly consent that the fulfillment of the contract begins during the withdrawal period, and you acknowledge that the right of withdrawal is waived in such cases. We will provide confirmation of your consent to the fulfillment and waiver of the right of withdrawal in the order confirmation in a permanent manner.

Business customers do not have a right of cancellation or return.

Limitation of Liability

NoHo Partners Plc is not liable for any indirect or direct damages related to orders, deliveries, or products, except to the extent that mandatory provisions of consumer protection laws or other mandatory legislation have determined otherwise regarding such damages.

Disputes

We aim to settle any potential disputes related to your order primarily through negotiation. Therefore, please contact our Customer Service first to address the matter.

If a dispute regarding these terms of service cannot be resolved through negotiations between the parties, consumers can submit the case to the Consumer Disputes Board (www.kuluttajariita.fi) for resolution. Before taking the matter to the Consumer Disputes Board, the consumer must contact the consumer advisory services of local register offices (www.kuluttajaneuvonta.fi).
